Throughout the site, "we", "us" and "our" refer to HEROHAVEN CY LTD. By visiting our site or buying from us you agree to these Terms of Service. Nothing in these Terms affects your statutory rights as a consumer.

By agreeing to these Terms of Service, you represent that you are at least 18 years old, or are using the site under the supervision of a parent or guardian. You may not use our products for any illegal or unauthorized purpose. A breach or violation of any of the Terms will result in an immediate termination of your Services. It is not necessary to register with us to use most parts of this website; however, particular areas may only be accessible if you have registered.

SECTION 2 - GENERAL CONDITIONS

We reserve the right to refuse Service to anyone for any reason at any time. You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service without express written permission by us.

SECTION 3 - ACCURACY OF INFORMATION

We are not responsible if information made available on this site is not accurate, complete or current. The material on this site is provided for general information only. Any reliance on the material on this site is at your own risk.

SECTION 4 - MODIFICATIONS TO SERVICE AND PRICES

Prices for our products are subject to change without notice. We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

SECTION 5 - PRODUCTS AND COLLECTIBLES CONDITION

Certain products may be available exclusively online through the website. These products may have limited quantities and are subject to return or exchange only according to our Refund Policy.

  • Colour accuracy: we cannot guarantee that your screen shows colours accurately.

  • Condition and packaging: as a collectibles retailer, we understand condition matters. Unless you contact us before dispatch with special instructions, we do not guarantee perfect "mint" outer packaging, and minor shelf wear or small creases on outer packaging are not, on their own, treated as damage. This does not limit your right to goods that are of satisfactory quality, as described, and fit for purpose.

  • Quantity Limits: We reserve the right to limit the quantities of any products or Services that we offer to any person or household.

SECTION 6 - SHIPPING & DELIVERY

Dispatch, delivery times and costs are set out in our Shipping Policy. We will deliver your order without undue delay and in any case within 30 days of your order, unless you have agreed a later date (for example on a pre-order).

SECTION 7 - CANCELLATIONS, RETURNS & REFUNDS

Our Returns & Refund Policy and Cancellations & Pre-orders Policy form part of these Terms.

  • Statutory right: you can cancel an order for goods from the moment you place it until 14 days after you receive the goods.
  • Cancelling before dispatch, and pre-orders: see the Cancellations & Pre-orders Policy for the applicable fees and deposits. The 10% figure in the previous version of these Terms no longer applies.
  • Exclusions: the right to cancel does not apply to items made to your specification, or to sealed items that cannot be returned for health or hygiene reasons once unsealed.
  • Return costs: if you change your mind, you pay the cost of returning the goods, and you are responsible for them until they reach us.

SECTION 8 - ACCURACY OF BILLING & ACCOUNT INFORMATION

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. This includes orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

SECTION 9 - THIRD-PARTY TOOLS & LINKS

We may provide you with access to third-party tools (like shipping trackers) which we neither monitor nor have any control over. We are not liable for any harm or damages related to the purchase or use of goods or services made in connection with any third-party websites.

SECTION 10 - USER COMMENTS & FEEDBACK

If you send us creative ideas or suggestions, you agree that we may, at any time, without restriction, edit, copy, and distribute them. We are under no obligation to pay compensation for any comments.

SECTION 11 - PROHIBITED USES

You are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to infringe upon our intellectual property; (c) to upload viruses or malicious code; (d) to crawl, scrape, or spider the site for data.

We do not guarantee that the service will be uninterrupted or error-free. Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded, and nothing affects your statutory rights as a consumer. Subject to that, we are not liable for loss of profit, loss of business, or losses that were not a reasonably foreseeable result of our breach.

You agree to indemnify HeroHaven and our partners harmless from any claim or demand, including reasonable legal fees, made by any third-party due to your breach of these Terms of Service.

SECTION 14 - SEVERABILITY & TERMINATION

If any provision of these Terms is determined to be unlawful or void, such provision shall be severed, and the remaining provisions shall remain valid. These Terms are effective unless and until terminated by either you or us.

SECTION 15 - GOVERNING LAW

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the United Kingdom.
